Yes, child support can count as qualifying income on an FHA loan, but only when it is court-ordered, documented, and likely to continue for at least three years. A child support income mortgage file lives or dies on paperwork: the order, the payment history, and the end date. Support you pay works the opposite way, because it is a monthly obligation that raises your debt-to-income ratio.

Which half applies to you changes everything about how your file is built. A parent receiving $900 a month can see a borderline application become comfortable. A parent paying $900 a month may need a lower purchase price to stay inside the ratios. Duane Buziak walks both kinds of borrowers through this at FHA Mortgages by Duane Buziak, and the rules below are the same ones an underwriter will apply to your file.

When Child Support Qualifies as FHA Income

Quick answer: Under HUD Handbook 4000.1, child support is acceptable stable income if a divorce decree, court order, or similar legal document requires it, you can document consistent receipt, and it is expected to continue for at least three years from the FHA case number assignment date.

That definition has three tests, and a file needs all of them. The obligation must be legal, not a handshake agreement. The money must actually be arriving. And enough time must remain on the order for a lender to treat it as dependable.

You are never required to use it

The Equal Credit Opportunity Act, implemented through Regulation B, says a lender cannot ask you to disclose child support, alimony, or separate maintenance income unless you choose to rely on it to qualify. If your salary alone carries the loan, you can leave support out entirely. If you want it counted, you offer it, and then it must meet the documentation standard like any other income. The CFPB publishes the rule text at consumerfinance.gov.

Received versus paid

If you receive support, read sections 2 through 4. If you pay support, skip to section 5, where the payment becomes a liability in your ratios. Some borrowers do both, for example paying support for one child while receiving it for another, and each side is treated separately.

The Three-Year Continuance Rule and How to Check Yours

Continuance is the length of time an income stream is expected to keep arriving. For child support, HUD Handbook 4000.1 requires that it continue for at least three years, and the clock is measured from the FHA case number assignment date, not your closing date. Case numbers are assigned early, often when the lender orders one after you have a contract, so the practical difference is small, but the reference point matters if your order is close to the line. Confirm the current wording at HUD’s Handbook 4000.1 page, since handbook language is updated periodically.

An illustration: suppose your child turns 18 in 2027 and your order ends at 18. Counting three years forward from a case number assigned in late 2026 lands in late 2029, so the support stops well short and generally cannot be used. If your child turns 18 in 2031, the same order clears the test with room to spare.

Where the end date hides

The termination terms sit in your divorce decree, separation agreement, or court order. Some orders end at 18. Others run until high school graduation, emancipation, or a set calendar date. State rules differ on what extends or ends support, so read the actual language rather than assuming age 18.

A four-step check

  1. Locate the current order. Use the most recent version, including any modification, not the original decree.
  2. Identify every termination trigger. Note age, graduation, emancipation, and any fixed end date.
  3. Count forward from today. As of October 2026, you need the earliest trigger to fall after October 2029, and later if your case number is assigned later.
  4. Flag pending changes. A modification request in court can reduce the amount or shorten the term, and an underwriter will want to know about it.

Documents Needed to Prove Child Support Income

Underwriters want two things: proof the obligation exists and proof it is being paid. Missing either one removes the income from your file.

Proof of the obligation

You need the divorce decree, court order, or a notarized separation agreement that states the dollar amount and how long payments will last. A page that lists the amount but not the duration is a common gap, so bring the full document, signature pages included.

Proof of receipt

Lenders look for a record of full, regular, and timely payments. The history is commonly 12 months, though the exact period is set by HUD Handbook 4000.1 and can change, so Duane Buziak confirms the current requirement against the handbook when your file is built. Acceptable evidence usually includes:

  • Bank statements showing deposits that match the order amount
  • State disbursement unit payment histories, which are often the cleanest record
  • Canceled checks, if payments arrive by check

What causes trouble

  • No court order. Informal or cash support, however reliable, is not usable income.
  • Inconsistent payments. Late, partial, or skipped months can lead an underwriter to exclude the income or average it down to what actually arrived.
  • Deposits that do not match. If the order says $900 and your statements show varying amounts from several sources, expect questions.

Duane Buziak reviews these documents before you apply, so gaps show up while there is still time to fix them. That might mean pulling a state payment history, finding a missing page of the decree, or waiting a few months so the receipt record is complete.

How Underwriters Calculate Child Support Income

The starting number is the monthly amount in the court order, checked against what you have actually received. If receipts match the order, the order amount is used. If they run lower, the underwriter may use the lower average.

Gross-up

Child support is not taxable, and FHA guidelines allow nontaxable income to be increased, or grossed up, to reflect the pre-tax income it would take to net the same amount. A 15 percent gross-up is commonly applied without further tax analysis, though the handbook allows a lender to use a documented tax rate instead. Confirm the current percentage in Handbook 4000.1 before relying on it for your own file.

An illustrative example

Suppose a borrower earns $4,200 a month in gross employment income, receives $900 a month in court-ordered support, and has $350 in monthly debts (car and credit card). She is buying a $240,000 home in Henrico County, where the real estate tax rate is $0.85 per $100 of assessed value (as of this writing, per henrico.us; confirm the current rate). These are illustrative assumptions, including a 6.5 percent rate, not a quote.

  • Base loan with 3.5% down: $231,600. Financed upfront MIP of 1.75% adds $4,053, for a total loan of about $235,653.
  • Principal and interest: about $1,490. Annual MIP at 0.55%: about $106. Property tax: $170. Assumed homeowners insurance: $120.
  • Total housing payment: about $1,885.

Without the support, housing alone is roughly 45% of income, and with the $350 in debts the back-end ratio is about 53%. Add $900 grossed up 15% to $1,035, and income becomes $5,235. Housing falls to about 36% and total debt to about 43%. Counted without the gross-up ($5,100), the back-end ratio would be about 44%.

FHA’s traditional benchmarks are 31% housing and 43% total, and FHA’s automated underwriting (TOTAL Scorecard) can approve higher ratios when other strengths are present. Even so, this is the kind of file where documented support moves an application from unlikely to workable, or from a smaller loan amount to the one you wanted.

Paying Child Support: How It Affects Your FHA Debt-to-Income Ratio

Court-ordered support you pay is a recurring monthly obligation, and it counts in your debt-to-income ratio even though it never appears on a credit report. If you pay $700 a month, an underwriter adds $700 to your monthly debts just as they would a car payment. Many borrowers assume that because nothing shows on their credit, the payment is invisible. It is not: the divorce decree, bank statements, and pay stubs with garnishments all reveal it.

The effect is large. On $5,000 of monthly income, $700 of support consumes 14 points of the back-end ratio before a mortgage payment is counted. That often means qualifying for a lower price range, which is better to learn before you tour homes.

Arrears

Past-due support is a separate problem. Underwriters generally expect arrears to be addressed, either paid or covered by a documented repayment arrangement, and a history of missed payments invites scrutiny. FHA loans also screen borrowers through CAIVRS, which flags delinquent federal debt. Child support arrears are typically a state matter rather than a federal debt, but how any particular delinquency is handled depends on the file and the underwriter, so do not assume it will be ignored. Duane Buziak checks this early rather than leaving it for underwriting to find.

What to bring to the first conversation

  • The current court order, with any modifications
  • An arrears or payoff statement from the state agency, showing a zero balance or the amount owed
  • A payment history confirming you are current

Child Support Income and FHA Minimum Requirements

Qualifying income is only one piece of an FHA approval. The borrower still needs to meet the standard program requirements, and the credit score determines the minimum down payment. As of October 2026, per HUD Handbook 4000.1 (hud.gov):

  • Credit score 580 or higher: minimum down payment of 3.5%
  • Credit score 500 to 579: minimum down payment of 10%

His access to 500+ wholesale lenders also means your file is not limited to one company’s overlays. The Dare to Compare pricing challenge lets you test any other quote against his.

Mortgage insurance

Upfront MIP is 1.75% of the base loan amount, usually financed. Annual MIP depends on loan term, loan amount, and LTV. For terms over 15 years with a base loan of $726,200 or less, per HUD Mortgagee Letter 2023-05 (hud.gov):

  • LTV of 95% or less: 0.50% annually
  • LTV above 95%: 0.55% annually

Other tiers apply to larger loans and shorter terms, so your rate is confirmed against your actual loan.

Loan limits

For 2026, the FHA one-unit limit is $541,287 in the lowest-cost areas and $1,249,125 in the highest-cost areas, per HUD Mortgagee Letter 2025-23, verified October 2026 at hud.gov. Your county’s limit falls somewhere in that range.

Common Questions About Child Support and FHA Loans

Can I use child support income for an FHA loan?

Yes, if it is court-ordered, documented, and expected to continue for at least three years.

Does child support need to last 3 years?

Yes. HUD measures the three years from the FHA case number assignment date. Support ending sooner generally cannot be counted.

Do I have to disclose child support income?

No. Federal law lets you leave it out. If you do, it cannot be used to qualify.

Does paying child support hurt FHA approval?

It raises your debt-to-income ratio, which can reduce the amount you qualify for, but it does not disqualify you on its own.

Can I use informal or cash child support?

No. Without a court order or legal agreement, it is not usable income.

How long a payment history do I need?

Commonly 12 months of documented receipt. The requirement is set by HUD Handbook 4000.1, and Duane Buziak confirms the current standard for your file.

Does child support get grossed up?

Because it is nontaxable, it can be grossed up, commonly by 15%, subject to the current handbook.

What if I am behind on support?

Expect to resolve the arrears or document a repayment plan before closing. Bring an arrears statement early.

What if a modification is pending?

Disclose it. A change to the amount or term can alter how much income counts.

Does FHA Mortgages by Duane Buziak act as a lender?

No. Duane Buziak is a mortgage broker who shops your file across 500+ wholesale lenders.
